TRADEMARK APPLICATION PROCEDURES AND FEES IN TURKEY

 

 

 

 

 

 

 

 

 

 

After filing an application, subject mark is examined according to
the absolute grounds of refusal. If there are no deficiencies and
there is not a previous identical registration or application
preceding the application in question, then it will be published in a
monthly based bulletin and available for oppositions and/or third
party observations for two months. If no opposition raised, the
trademark application will be granted for registration. After paying
the registration fee, trademark registration certificate will be issued
by TURKPATENT and registration will be published in the Official
Turkish Trademark Gazette. This proceeding takes approximately 8
to 14 months from filing until issuance of certificate.
Please be informed that the term of protection is calculated from
the date of the application and it is 10 (ten) years.
Applicants are invited not to use general terms and broad
descriptions in respect of the goods and services and obliged to use Nice Classification.
Evidence of use is not required in our territory however a
registration may be subject to a cancellation action due to non-use
after five consecutive years after the date of the registration.

 

 

 

 

 

 

 

 

 

Documents requested in order to file a new trademark application in
Turkey are summarized here in below;

  • Particulars of the applicant (name, address, telephone, fax, …etc)
  • Sample of the mark in JPEG format, if any
  • Detailed list of goods and/or services in English according the
    Nice Classification latest Edition,
  • Priority claim, if any
  • Power of Attorney duly executed by the applicant and simply
    signed and company sealed, where legalization or notarization is
    not required. Sample of our PoA will be sent upon your request
    by email.

 

Kindly note that it is possible to file a multi-class
application and therefore, the cost may vary according to
the number of the classes concerned.

A trademark registration will be valid for ten years
starting from the date of the application and can be
renewed within every ten years period.

The renewal application should be filed within six
months prior to the expiration date. The renewal can be
filed with penalty within six months after the renewal due date.

DESIGN REGISTRATION PROCEDURES

 

 

 

 

Registered Design rights are obtained by registration and
registration procedures are performed by novelty examination at
the Turkish Patent and Trademark Office, and then published for
opposition by third parties. The procedures for design protection in
Turkey are similar to the system applied in European Union Designs
(formerly known as Community Designs) and other European
Countries.

General remarks of Turkish Design Protection System are
summarized below;

  • Publication of designs for opposition by third parties for 3 months,
  • Term of Protection is 5 years and can be extended up to 25 years by 4 times renewal,
  • Deferment of publication is available up to 30 months,
  • Multiple application is avaliable in the condition of; designs failing at the same Locarno class,
  • The application should be filed within 6 months period if there is a priority claim.

 

In the Turkish Design Protection System, a design which is new and
has an individual character shall be granted for protection.
A design shall be considered new, if there is no identical design has
been made available to the public in the world before the date of the
application/priority. Designs differing only in immaterial details
shall be deemed as identical. To make available to the public shall
cover of all actions of sale, use, publication, publicity, exhibiting, or

Documents requested for fiiling design registration applicatioon in Turkey;

  • Particulars of the applicant (name, address, telephone… etc.)
  • Particulars of the designer(s) (name, address, telephone… etc.)
  • Date of disclosure to the public, if any
  • Visual representations showing all the novel and individual characteristics of the design to be protected
  • The Power of Attorney, duly executed on behalf of the applicant
    and signed, sample is enclosed where legalization or
    notarization is not required
  • Priority Document, if any
  • Deferment of publication request, if any (available up to 30
    months)

 

In terms of fees, the cost shall vary according to the
number of the designs and the number of the views.
