Documents Needed for Application (Filing) of Industrial Propert Rights

     The documents needed for applicaiton (filing) for registration of industrial property rights are briefly explained below for patent, utility model, trademark and industrial design rights

         Application for Granting Patent or Utility Model

      An application for granting patent or utility model must be filed with the following:

  • application petition, including title of the invention, information concerning the applicant or the applicants' name, nationality, address, postal code, telephone number, fax number, country; information about the agent (if agent is appointed), information with respect to the application on which the priority is based (if priority is claimed), information concerning the inventor: name, nationality, address; where the applicant is not the inventor, declaration concerning how the right to apply has been obtained ... etc
  • description specifying the invention,
  • claim or claims with respect to the elements of the invention for which protection is requested,
  • drawings referred to in the description, claim or claims,
  • abstract,
  • receipt for the payment of the application fee.

 When the description, claim or claims and the abstract are submitted in English or French or German, translation of the description and claims in Turkish can be filed in one month after filing date by paying additional fee.

    
      Application for Trademark Registration

       An application for registration of a trademark must be filed with the following:

  • application petition, including full name (title), address and telephone and fax numbers of the aplicant,
  • 20 representation (samples) of the trademark (maximum 7x7 cm. minimum 5x5 cm.) suitable for reproduction,
  • list of the goods and/or services for which the trademark shall be used,
  • priority information (if exists)
  • the original receipt documenting the payment of the application and class fees,
  • power of attorney (simply signed, without legalization) if an agent is appointed. Agent is required for foreign applicants

     The application fee must be paid at the time of filing in order an application for the registration of a trademark to be valid. Each trademark shall be subject to a separate filing of an application.

 




Application for Registration of Industrial Design

    An application for registration of an industrial design must be filed with the following:

  •  application petition, including full name (title), address and telephone and fax numbers of the aplicant,
  • 15 copies of the representation (8x8 cm) of the design, one of which is to be affixed on the petition. for three dimensional designs, to allow better description of the design, top, bottom and side views must be given.
  • the original receipt for the payment of the application fee, for multiple applications the receipt for the additional fee,
  • power of attorney (simply signed, without legalization) if an agent is appointed, The power of attorney shall be notarized for acts relating to withdrawal or cancellation of an application. Those who are not domiciled in Turkey have to appoint an agent in Turkey in order to register their designs and to utilize their design rights,
  • 4 copies of written description of the design,
  • in case of multiple applications separate descriptions and representations of the designs,
  • a sample of the product in maximum 20x30 dimensions where the object of the application is a two-dimensional design and a deferment of publication is requested, and if it is not possible to supply a drawing, painting, graphic, photographic or similar representation of the design suitable for reproduction reflecting all of its specific features,
  • if a priority right is claimed, documents evidencing the priority claim to be obtained from the relevant authority of the country of application and its Turkish translation,
  • where the priority claim concerns an exhibition in Turkey, a certified copy of a document obtained from the officials of the exhibition specifying the name of the product, first display date and the official opening date along with photographs showing the product at display clearly and at its entirety, For the products displayed in foreign countries, the evidence shall be supplied by the relevant authorities of the state concerned.
